This order and any shipment hereunder is subject to ALL terms and
conditions of The Carrier's tariffs, pursuant to the Uniform Straight Bill
of lading, copies of which are available to shipper at the office of The
Carrier.
- CJ's Auto Transport (MC#529103) agrees to have vehicle(s) described
on quotation shipped on or about dates requested. CJ's will
designate a reliable carrier (agent) to fulfill the terms & conditions of
this agreement. CJ's or its agents do not guarantee transport by any
specific driver/carrier.
- Shipper warrants that he or she is the registered legal owner of
described vehicle(s) or has been authorized by the legal owner to enter
into said agreement for transportation of said vehicle(s).
- Shipper understands that the Carrier is liable for any and all
damages, liability, and clams and therefore agrees to hold CJ's Auto
Transport harmless and blameless, and exempt from all claims. If
damage occurs during transport, a claim must be filed in writing, within 7
days of deliver or as stated on the back of the BOL, to the Carrier.
All monies owed for transport must be paid to initiate a claim.
Damage must be noted in the proper place on the Bill of Lading and
signed by the driver and the shipper. Signing the Bill of Lading at
the destination WITHOUT any notations shall be evidence of satisfactory
damage-free deliver of the vehicle(s) and that CJ's and its agents are
relieved of any further responsibility. Inspect your vehicle(s)
before signing your name and receiving your vehicle(s).
- As standard in the auto transport industry, Carrier and agents
cannot guarantee any delivery date. Shipper understands that service
is subject to delay. Neither Carrier nor agents are responsible for car
rentals or any other special consequential damages, including non-use of
the vehicle(s) while undergoing transport.
- CJ's hereby notifies shipper that his/her vehicle will be driven on
and off the transporter, and possibly to and from the transporter at the
pickup or delivery site, should the carrier be unable to access either
site. This does not relieve the consignee from making a reasonable
effort to meet the truck at a suitable location. Be sure
to have mileage noted on the BOL at pickup and at delivery.
- If for any reason you
cancel your order with CJ's Auto Transport before 14 days from booking, a $25.00 cancellation fee will
be accessed and the remaining monies paid as a deposit shall be refunded.
We CANNOT refund your deposit if a Carrier has been scheduled to pick up
your vehicle(s).
- Deposit must be paid in order to initiate a transport. It
must be paid by certified check to CJ's Auto Transport, 8335 Buffalo Road,
Harborcreek, Pa 16421 OR paid through
www.paypal.com to
cjautotransport@peoplepc.com
- Unless the order has been pre-paid, or other arrangements have been
pre-made, Shipper shall pay all COD amounts, including any additional
charges, in lawful money of the United States of America or certified
funds only, as decided by the carrier. In the event that said forms or payment are not available at
delivery, or should the Shipper be unable to accept delivery for any
reason, the vehicle(s) shall be placed in storage and that Shipper shall
be responsible for any and all storage fees assessed.
- Shipper agrees that personal items are limited to a maximum of 100
pounds in the trunk or cargo area of the vehicle(s) and that the Carrier's
insurance does not insure personal items. The Carrier will not be
responsible for loss or damage to personal belongings, including without
limitations, any personal property that is not factory installed and that
are not a part of the vehicle(s).
- Shipper shall pay an additional $250 for any vehicle(s)
or any vehicle(s) that becomes inoperable during transport, for any reason
and an additional amount for each oversized or overweight vehicle(s)
unless such vehicle(s) are disclosed as being inoperable, oversized or
overweight, respectively, on the quote form and shipping order. The
shipper agrees that should this vehicle become mechanically inoperable for
any reason during transport, through no fault of CJ's Auto Transport
and/or its independent contractors and carriers, repair costs will be
added to the transport fee to be collected at the time of delivery.
- The shipper is responsible for preparing the vehicle for transport.
All loose parts, fragile or protruding accessories, low hanging spoilers,
etc must be removed and/or properly secured.
- The shipper is responsible for completely disarming any alarm
system installed on vehicle(s). The shipper must provide keys or remotes
for any alarm system. In the event that the car alarm sounds, the
transporter is required to silence the alarm by any means he deems
reasonable and effective.
- CJ's Auto Transport and its agents are fully licensed, insured and
bonded.
In addition to the above, The Carrier shall not be responsible for:
- Scratches, paint chips, pits, etc which are not visible at time of
inspection due to poor preparation of vehicle by shipper or due to poor
visibility (rain, snow, darkness, etc).
- The Carrier is not responsible for canvas or convertible tops that
are loose, torn or have visible wear, vehicle(s) boots, caps, masks, bras,
or any other type of canvas material or material covering.
- Damage caused by leaking fluid, acids, cooling system antifreeze,
industrial fallout or damage caused by any acts of God.
- Any mechanical function damages to include, but not limited to, the
engine, transmission, rear end, motor mounts, drive trains, wring system.
cooling systems., window motors, radios, stereo systems. power steering,
airbag, brake cable or brake system. clutch cable, or clutch,. engine
tunings, vehicle(s) computerized systems, any switch, alignment or
suspension, (anything that a driver is unable to inspect during pick up of
the vehicle(s).
This agreement supersedes all written and/or oral agreements between
Carrier and the Shipper and shall not be changed by any device except when
in writing by an officer of CJ's Auto Transport and so posted on this
